Study on legal foundation of vocational rehabilitation services for people with disabilities: Focused on Act on Welfare of Persons with Disabilities

Abstract
The purpose of this study is to examine how the vocational rehabilitation service for the disabled is defined in the Act on Welfare of Persons with Disabilities, the Enforcement Decree and the Enforcement Rules of the same Act, the Disability Welfare Service Guidelines, and the legal contents are relevant and enhance the legal foundation. As a method of research, literature analysis was mainly conducted on related laws, research papers, and reports, and the results of the research were as follows. First, vocational rehabilitation services were referred to in the Act on Welfare of Persons with Disabilities as six categories, such as job guidance, vocational competency assessment, job adaptation training, job training, job placement, employment and post-employment guidance, but have little connection with the Enforcement Decree or the Enforcement Regulations. Most of the vocational rehabilitation services are provided in [Appendix 4 and 5] of the Enforcement Rules and the Service Guidelines to welfare for persons with disabilities, but the Enforcement Rules and Project Guidance can be said to be almost similar rather than linked. In this study, based on the research results, five recommendations were proposed to enhance the legal foundation of vocational rehabilitation services, including the fact that the concept and contents of vocational rehabilitation services should be more clearly presented in relevant laws and regulations.
